1. Introduction

Welcome to MITHANSH Mart (“MITHANSH Mart”, “we”, “us”, “our”).

MITHANSH Mart is a multi-vendor online marketplace that connects customers with independent sellers, manufacturers, wholesalers, retailers, home-based businesses, artisans, farmers, brands and other businesses.

Our platform allows Sellers to list and offer products and enables Customers to discover and purchase products through the marketplace.

By accessing, browsing, registering on or using www.mithansh.com, you agree to comply with these Terms & Conditions.

2. Definitions

“Platform”

The Seller is primarily responsible for:

• Packaging
• Product compliance
• Applicable licenses
• Applicable taxes
• Invoicing, where applicable
• Product warranty, where applicable
• Order fulfilment

MITHANSH Mart may provide marketplace infrastructure, payment facilitation, order management, customer support, marketing, delivery coordination and other related services.

5. Product Listings

Sellers must provide accurate and complete information for every Product listed on MITHANSH Mart.

Product listings may include:

• Product name
• Product images
• Product description
• Specifications
• Brand
• Quantity
• Size
• Colour
• Price
• Applicable taxes
• Stock availability
• Warranty information
• Return information
• Delivery information

MITHANSH Mart may review, restrict, suspend or remove a Product listing if it violates applicable laws, Platform policies or these Terms.

6. Product Information

MITHANSH Mart makes reasonable efforts to display accurate Product information.

However, actual Products may differ slightly from displayed images due to:

• Lighting
• Photography
• Packaging changes
• Manufacturing variations

Customers should review the Product description and specifications before placing an Order.

7. Pricing

Product prices may be determined by individual Sellers.

The applicable price and payable amount will be displayed during checkout.

8. Product Availability

Product availability depends on Seller inventory.

Listing a Product on the Platform does not guarantee that the Product will remain available until Order fulfilment.

If a Product becomes unavailable after an Order is placed, the Order may be cancelled or partially cancelled and applicable amounts may be refunded.

9. Orders

Placing an Order constitutes a request by the Customer to purchase the selected Product.

An Order may be cancelled or rejected in circumstances including:

• Seller's inability to fulfil the Order
• Fraudulent or suspicious activity

• Other agreed Platform fees

Applicable charges will be communicated through Seller policies, Seller agreements, pricing plans or the Seller dashboard.

12. Seller Settlement

Where applicable, Seller payments may be processed through the Platform's payment and settlement infrastructure.

MITHANSH Mart may deduct applicable:

• Marketplace commission
• Payment processing charges
• Platform fees
• Shipping charges
• Refund-related amounts
• Applicable taxes or statutory deductions
• Other agreed charges

Seller settlement timelines may depend on payment gateway, banking, refund, dispute and other applicable processes.

13. Delivery and Shipping

Products may be delivered through:

• Seller delivery
• Courier companies
• Logistics partners
• Third-party delivery providers
• Other authorised delivery services

Estimated delivery dates are indicative and may vary because of:

• Seller processing time
• Product availability
• Customer location
• Weather conditions
• Transport delays
• Public holidays
• Government restrictions
• Technical or operational issues
• Other circumstances beyond reasonable control

Customers are responsible for providing a correct delivery address and contact details.

14. Shipping Charges

Shipping charges, where applicable, will be displayed during checkout or otherwise communicated to the Customer.

15. Cancellation, Return and Refund

18. Taxes and Invoicing

Sellers are responsible for complying with applicable tax laws relating to their business and Products.

Where applicable, Sellers must issue valid tax invoices and other legally required documents.

Sellers are responsible for providing correct GST, PAN and other business information wherever required.

MITHANSH Mart may request business and tax documents from Sellers for verification and compliance purposes.

19. Prohibited Products and Activities

The following may not be listed or sold on MITHANSH Mart unless specifically permitted under applicable law and Platform policies:

• Counterfeit products
• Stolen goods
• Illegal products
• Fraudulent products
• Unsafe products
• Products requiring licenses without the required license
• Products violating intellectual property rights

MITHANSH Mart may remove or restrict any listing that it reasonably believes violates applicable law or Platform policies.

20. Intellectual Property

The MITHANSH Mart name, logo, website design, graphics, text, software, layout, original content and other Platform materials are owned by or licensed to MITHANSH Mart / Mahalakshmi Foods, unless otherwise stated.

21. Seller Content

Sellers may provide product photographs, descriptions, logos, trademarks and other content for listing on MITHANSH Mart.

The Seller represents that it has the necessary rights to provide such content.

The Seller grants MITHANSH Mart permission to use such content for legitimate marketplace purposes, including:

• Website display
• Search results
• Advertising
• Marketing
• Social media promotion
• Promotional campaigns

22. Reviews and Ratings

Customers may submit genuine:

As a marketplace, MITHANSH Mart may facilitate transactions between Customers and independent Sellers.

The Seller remains primarily responsible for the Products listed by that Seller.

Nothing in these Terms limits any liability that cannot legally be limited or excluded.

30. Indemnity

To the extent permitted by applicable law, a User or Seller may be responsible for losses, claims, damages, penalties, costs or expenses arising from:

• Violation of these Terms
• Fraudulent activity
• Unlawful conduct
• Intellectual property infringement
• False information
• Misuse of the Platform
• Violation of third-party rights

31. Suspension and Termination

MITHANSH Mart may suspend, restrict or terminate an account in cases including:
